These Terms of Service ("Terms") apply when you use poemwear.com or buy from Poemwear by Akif Kichloo ("Poemwear", "we", "us"). Poemwear is run by Akif Kichloo. By using the site or placing an order, you agree to these Terms.

1. Our products

Poemwear sells apparel featuring original poems and hand-drawn sketches by Akif Kichloo. Every item is made to order and printed and shipped by one of our fulfilment partners:

  • Printrove, for orders delivered within India.
  • Printful, for orders delivered outside India.

The products and prices you see depend on the country you're shopping from. Colours on screen and printed colours can differ slightly because of display settings and the printing process. Measurements can vary slightly from the size chart.

2. Orders

Your order is confirmed once payment is received and we send you a confirmation email.

We may refuse or cancel an order, for example if:

  • an item is unavailable;
  • a price or product detail was listed incorrectly; or
  • we suspect fraud.

If we cancel an order you've paid for, we'll refund you in full. Because each item is produced for you, an order can't be cancelled once production has started. See our Refund & Returns Policy.

3. Prices and payment

  • All prices are in Indian Rupees (INR), including for international customers.
  • India: prices include applicable taxes.
  • International: prices don't include import duties or local taxes that your country may charge on delivery. See our Shipping Policy.
  • Shipping is free.
  • How you pay:
  • India: Razorpay (UPI, cards, net banking, wallets).
  • International: PayPal.
  • We don't see or store your full card or bank details.
  • Currency conversion: if your card or PayPal account is in another currency, your bank or PayPal converts the INR amount and may charge a conversion fee. That's outside our control.
  • We may change prices at any time, but changes never affect orders that are already confirmed.

4. Shipping and delivery

Production and delivery times, tracking, customs and failed-delivery handling are explained in our Shipping Policy. Delivery estimates aren't guaranteed.

Once the courier delivers to the address you gave us, the risk of loss passes to you.

5. Returns and refunds

Our Refund & Returns Policy explains how we handle misprinted, damaged, defective, wrong or lost items. It includes the time limits for reporting a problem and how refunds are paid.

6. Intellectual property

All poems, sketches, artwork, text, photographs, logos and other content on this site and on our products belong to Akif Kichloo and are protected by copyright and other laws.

Buying a product gives you the right to own, wear and enjoy it. It doesn't give you any right to copy, reproduce, adapt, print, sell or otherwise commercially use the poems, sketches or designs without written permission.

Sharing photos of yourself wearing Poemwear on social media is welcome. Tagging @akifkichloo is appreciated.

7. Using the site

Please don't misuse the site. That includes:

  • trying to get unauthorised access;
  • interfering with how it works;
  • scraping content; or
  • using it for anything unlawful.

8. Limitation of liability

To the fullest extent the law allows:

  • our total liability for any claim about a product or order is limited to the amount you paid for that order; and
  • we aren't liable for indirect or consequential losses, or for delays caused by couriers, customs or events outside our control.

Nothing in these Terms limits rights you have under India's Consumer Protection Act, 2019, or the consumer laws of your own country, where those rights can't be excluded.

9. Privacy

How we handle your personal information is explained in our Privacy Policy.

10. Governing law and disputes

These Terms are governed by the laws of India. Disputes are subject to the jurisdiction of the courts at Delhi, India.

11. Grievance contact

For complaints, contact our Grievance Officer at contact@akifkichloo.com. We'll acknowledge complaints within 48 hours and aim to resolve them within 30 days.

12. Changes to these Terms

We may update these Terms from time to time. The version on this page when you place your order applies to that order.
